What constitutes that a building be required to have Passive Fire Protection in place?

Hello All,
I'm dealing with Renton WA. Fire Inspectors for a 3,000 to 3,500 sq. ft. building that has been divided into suites. The suites are for purposes of Behavioral Health or Psychiatry (upstairs) and Payroll (downstairs). The Fire Inspectors are reciting IFC 703.1 for Maintaining Fire-Resistance Rated construction. They're requesting me to Firestop electrical closets (1B-027) and IT closets (1B-026) that are not rated, (please see attached drawing). Per the NEC 450.21 (B) Dry Transformers over 112.50 kVA require a min. 1 hr. fire rated construction. Not only are these closets not rated, they don't have transformers in them. The only rated wall/barrier on this schematic is the perimeter wall of the outside stairwell. I realize the AHJ has the last say, however, would you have any advice on how I could communicate with the Fire Inspectors ( There are four Inspectors from Renton Fire) and explain Passive Fire Protection through compartmentation and hopefully minimize any unnecessary Firestopping? I have spoke with one inspector and it was evident he did not understand Firestopping in detail as I thought he might. Hello Sean,

This is a tough situation.  I am not sure why he is requiring you to firestop this area since the wall is not required to be rated.  However, like you said, the AHJ is going to have the final word.

My best bet would be the explain to him that NEC 450.21 (B) does not apply since you do not have a transformer in your closet.

That being said, we do sell a product, Hilti CP 506 Smoke and Acoustic Sealant, that can be used to fill voids in non-rated walls.  Please see attached for further information on CP 506.

I hope it all ends well with your inspector!
